Service Agreement
The Parties agree that the Customer has contracted with Roman Pools to perform pool and/or spa maintenance. The Parties agree that this is a monthly Service Contract and Customer agrees to pay Roman Pools monthly in advance of the services to be provided that month.
1. Service Frequency and Fees: Roman Pools will provide pool service once a week at the Customer’s address stated. Customer agrees to pay an agreed upon service rate in advance each month for the service. Customer may request pool service twice a week for an additional $100 a month. Roman Pools will designate the service day that the pool will be serviced. Although we strive for consistency,
days can be adjusted at the discretion of Roman Pools.
The Parties agree that circumstances can arise that affect or prevent Roman Pools from performing pool and/or spa maintenance such as the weather, an illness, or a holiday. In such event, Roman Pools may elect to postpone pool
and spa service for one week, not to exceed 4 weeks each year. However, in no event shall pool and spa service be provided during the weeks of Thanksgiving and Christmas.
In the event of inclement weather on the scheduled date of service, the pool and spa will be cleaned to the extent weather permits. Only chemicals will be added, and baskets checked/emptied.
Customer must ensure Roman Pools has access to the service area on the scheduled service day, including: gate entry codes, lock combinations, security guard verification, and pets relocated from pool/spa area. If Roman Pools is
unable to access the service area for any reason, services will not be performed that week and Customer shall not be entitled to a credit.
Vacation/Holidays: Roman Pools will be closed and service will not be provided as follows: 1) Two weeks during the off-season (Customer will be notified of the week in advance), 2) Thanksgiving week, and 3) Christmas week, for a total of 4 weeks. These dates are already accounted for in calculating the monthly service fee (4 services per month, 48 per year, 52 weeks in a year). Therefore, no credit is due. In the event of an emergency, Roman Pools will make every effort to return your calls and answer emails. Emergency services are provided at a separate agreed upon rate quoted on a case by case basis. If any emergency arises during a designated vacation week, turn off the pool breakers, and/or autofill valve handle (usually above the backyard hose bib).
2. Services: Roman Pools shall provide the following services each week:
• Pool surface and floor skimmed
• Filter backwashed as needed
• Leaf baskets cleaned
• Pump baskets cleaned
• Pool equipment operation inspected
• Pool walls to be brushed
• Water tested and balanced each week
• Pool vacuumed as needed*
*All customers must have a properly working in-floor cleaning system, or suction side cleaner.
Customer is responsible for water levels during the week. Recommended water level is MID-TILE.
Chemicals are not included with your base rate. Chemical prices can be adjusted at any time. Filter cleaning is NOT included as a monthly service and will only be cleaned every 4 months, unless extra service is required. Filters
MUST be properly maintained in order for Roman Pools to perform proper maintenance service. All standard service is billed at a rate of up to 15 minutes per week, and any additional labor charges will be billed at a rate of $25 per each additional 15 mins. I.E. Storm Cleanup, Excessive Debris, and any other situations out of the normal scope of work for your swimming pool.
3. Repairs: Repairs are not included in the monthly service fee. Repairs under $50 per occurrence will be performed immediately and charged separately to the Customer. Repairs greater than $50 per occurrence shall require Customer authorization in advance of the repair.
4. Pricing: Customer agrees to pay Roman Pools the monthly service fee agreed upon as well as any additional costs that may be incurred for chemicals, repairs,
or services that are in addition to the services specified above. Additionally, Customer shall incur an additional charge every 4 months for filter cleaning, excluding customers with Sand Filters. Customer shall incur an additional charge every 36 months for pool draining and startup.
5. Payment: Roman Pools accepts 3 forms of payments, our Invoice Portal via PayPal with a 3% technology fee for CC, Zelle - roman@romanpoolsllc.com or 520-610-1005, paypal.me/rmanl or by mailed check/bank billpay to Roman Pools 1923 N. Renford Lane Casa Grande, AZ 85122. Each monthly payment must be received by Roman Pools, in full, by the 15th of the serviced month. For example, the monthly payment for the October Invoice must be paid to Roman Pools before October 15th. We allow transit time for mailed checks. A $15 late fee will be charged for all late invoices. If payment is not received by the last day
of the month, all services will be paused until payment is received.
6. Disclaimer: Roman Pools shall not be responsible for any damage to property due to acts of nature, fire, vandalism, misuse, or abuse. Customer should be aware of normal deterioration of equipment that occurs over time due
to exposure to chemicals, sunlight, and, in some cases, other corrosive materials (i.e. salt). The Customer is responsible for maintaining correct water level at all
times. Also, Roman Pools is not responsible for any damages or deterioration caused by failure of a Customer to perform other services recommended by Roman Pools, or by failure of Customer to properly maintain pool and equipment between visits. Successful pools happen when the owner partners with Roman Pools in between visits. Finally, Roman Pools is not responsible for the deterioration of the pool surface (plaster/quartz/pebble) due to chemicals or age.
7. Termination: The Parties agree that this Agreement is a monthly service agreement that continues from month to month until terminated. The Agreement may be terminated by either Party. However, the Parties further agree that
Customer be serviced until the end of the serviced month.
